Scope

What a paralegal can do.

The licence is real, and so are its limits. If your matter needs a lawyer, you will hear it at the consultation.

A paralegal can

  • Give legal advice within the licensed areas
  • Represent you at the Landlord and Tenant Board
  • Appear in Small Claims Court to $35,000
  • Defend traffic and provincial offence charges
  • Act on summary matters under s. 802.1
  • Represent you at HRTO, WSIB, WSIAT, LAT and SBT
  • Negotiate and sign a settlement for you
  • Commission affidavits and administer oaths

You will need a lawyer for

  • Divorce, custody and support
  • Wills, trusts and estates
  • Buying or selling property
  • Incorporations and commercial agreements
  • Claims above $35,000 or in Superior Court
  • Indictable criminal charges
  • Appeals to Divisional Court or the Court of Appeal
  • Commercial eviction and distress

Those limits describe work done for you. Real estate and corporate files are taken on only as contract law clerk work for law firms, under a supervising lawyer — see for law firms.

Filing and service fees are billed at cost and set out in the retainer. If cost is the obstacle, say so at the consultation — payment plans exist, and so do Legal Aid Ontario and JusticeNet.
